TERMS AND CONDITIONS OF SERVICE

These Terms and Conditions govern the provision of residential and commercial painting services offered by [Trusted Painters Calgary] (hereinafter “the Company”) to individual and corporate clients (hereinafter “the Client”) within Canada. By engaging our services, the Client fully accepts these terms.

1. Services Offered

The Company offers, among others, the following services:

Interior and exterior painting.

Repainting, maintenance, and repair of surfaces.

Wall preparation (sanding, crack repair, cleaning, application of sealers).

Technical advice on colors, materials, and finishes.

Application of decorative or specialized products (if applicable).

The Company reserves the right to refuse services that pose safety risks, violate municipal regulations, or exceed the technical scope of the activity.

2. Quotes and Contracts

The quotations provided by the Company will be estimated based on the area, materials, execution time, and complexity.

Quotations are valid for 30 calendar days, unless otherwise indicated.

Any subsequent modification requested by the Client (additional colors, unforeseen repairs, changes in materials, expansion of work areas) will incur additional charges.

3. Payments

The Client shall make a minimum advance payment of 30%–50% of the total value before the project begins, in accordance with the Company’s policies.

The remaining payments must be made according to the schedule established in the contract or upon delivery of the work.

The Company accepts the payment methods indicated in the quotation or invoice.

In the event of non-payment within the agreed-upon timeframe, legal interest may be applied in accordance with the applicable provincial laws of Canada.

4. Materials and Warranty

The Company will use the materials specified in the quotation, and may only substitute them with equivalent or higher-quality products if they are not available.

The workmanship warranty will cover application defects for a period of 3 to 12 months, depending on the type of service, excluding:

Natural wear and tear.

Damage caused by moisture, leaks, poor structural conditions, vandalism, or improper handling by third parties.

Painting on unsuitable or deteriorated surfaces previously reported to the Client.

5. Safety and Responsibility

The Company complies with provincial occupational health and safety regulations, including the Act Respecting Occupational Health and Safety as applicable in each province.

The Client shall provide safe and accessible work areas.

The Company shall not be liable for any pre-existing damage to the property or for accidents arising from defective installations (faulty outlets, unstable ceilings, leaks, etc.).

6. Cancelations and Rescheduling

The Client may cancel a scheduled service with at least 72 hours’ notice. Cancelations made outside of this timeframe may incur an administrative fee equivalent to 10% of the total project value.

The Company reserves the right to reschedule outdoor work in adverse weather conditions or for safety reasons.

7. Intellectual Property and Advertising

The Company may take photographs of completed work for commercial and advertising use, unless the Client requests in writing that they not be used.

The designs or advice provided by the Company are protected by copyright and may not be reproduced without authorization.

8. Limitation of Liability

The Company shall not be liable for indirect damages, financial losses, lost profits, business interruption, or impairments caused by deficient structural conditions of the property.

9. Applicable Legislation

These Terms and Conditions are governed by the laws of Canada and by the provincial legislation applicable to the place where the service is performed. Any dispute shall be resolved by the courts of the relevant province.

10. Acceptance

By making the initial payment or signing a quotation or contract, the Client fully accepts these Terms and Conditions.
